Terms of service

These Terms of Service ("Terms") govern your access to and use of mlc-advance.com, any Money Loan Capital mobile application, and related services (collectively, the "Services") provided by Money Loan Capital, LLC ("Money Loan Capital," "we," "our," or "us"). Please read them carefully. These Terms do not constitute a loan agreement. Any loan you obtain from us is governed by a separate loan agreement that you will sign electronically before any funds are disbursed.

1. Acceptance of these Terms

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

To use the Services, you must:

• Be at least 18 years of age (19 in Alabama, 21 in Mississippi and Puerto Rico);
• Be a U.S. citizen or permanent resident with a valid Social Security number;
• Maintain a valid U.S. personal checking account in your own name;
• Not be an active-duty service member, spouse of an active-duty service member, or a covered dependent under the federal Military Lending Act; and
• Reside in a state where Money Loan Capital currently offers loans (see our Licenses & Disclosures page).

3. Account registration

You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for safeguarding your password and for all activity that occurs under your account. Notify us immediately at security@mlc-advance.com of any unauthorized access.

4. Pre-qualification, applications, and loan offers

Pre-qualification results and loan offers provided through the Services are conditional and subject to verification, final underwriting, identity confirmation, and execution of a written loan agreement. Nothing on the Services constitutes a commitment to lend.

5. Electronic communications and E-Sign consent

You agree to receive all notices, disclosures, and communications from us electronically as described in our E-Sign Consent. You may withdraw E-Sign consent at any time, with the consequences described in that document.

6. Permitted use

You agree that you will not:

• Use the Services to submit false, inaccurate, or misleading information;
• Use the Services on behalf of another person or business without authorization;
• Reverse engineer, decompile, or otherwise attempt to derive source code from the Services;
• Interfere with or disrupt the Services, our servers, or networks, or attempt to gain unauthorized access;
• Use the Services in violation of any applicable law or regulation.

7. Intellectual property

The Services and all content, trademarks, logos, and software are owned by Money Loan Capital or our licensors and are protected by U.S. and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes.

8. Third-party services

The Services may contain links to or integrations with third-party services (such as bank-linking via Plaid). We are not responsible for the content, policies, or practices of any third party. Your interactions with third-party services are governed by their own terms and privacy policies.

9. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free. Nothing in these Terms limits any warranty or consumer protection that cannot lawfully be limited.

10. Limitation of liability

To the maximum extent permitted by law, Money Loan Capital will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or in connection with the Services. Our aggregate liability for any claim relating to these Terms or the Services is limited to one hundred dollars ($100). Nothing in these Terms limits liability that cannot lawfully be limited.

11. Indemnification

You agree to indemnify and hold harmless Money Loan Capital and our officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any law or third-party right.

12. Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms will be resolved in the state or federal courts located in Essex County, New Jersey, unless you are a consumer and applicable consumer protection law provides otherwise.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice by email or a prominent notice on the Services at least thirty (30) days before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without cause. You may terminate your account at any time by contacting us at support@mlc-advance.com. Termination does not relieve you of any obligation to repay amounts owed on a loan.
